This is a public hearing on a permanent rule, Board Order WY-23-19, to revise chapters NR 102, 105, 106 and 219, relating to adding narrative surface water criteria with numeric thresholds for poly- and perfluoroalkyl substances (PFAS) including perfluorooctane sulfonate (PFOS) and perfluorooctanoic acid (PFOA) for the purpose of protecting public health as well as revisions to the procedures in the Wisconsin Pollutant Discharge Elimination System (WPDES) permitting program to implement the new water quality criteria.
The public has the opportunity to testify at the hearing. To register and join the hearing online or by phone, use the information provided in the public hearing notice. Public Meeting on the CWD Response Plan Review

The Wisconsin Department of Natural Resources (DNR) has formed a committee made up of stakeholder organizations, tribal partners and other governmental organizations to conduct the second of three five-year reviews of the state’s 15-year chronic wasting disease (CWD) response plan.
Over the course of upcoming meetings, the committee will develop and provide input on the plan’s implementation and actions to consider as it completes this second five-year review. A panel of technical experts will attend meetings to support the committee’s work. All meetings will be open to the public, and recordings will be posted to the DNR website. Governor’s Off-Highway Motorcycle Advisory Council Meeting

The Off-Highway Motorcycle Council provides advice and makes recommendations to the Department of Natural Resources (DNR), the Department of Transportation, the Governor and the Legislature on all matters relating to off-highway motorcycle trails, including matters relating to activities conducted on off-highway motorcycle trails and by off-highway motorcycle users, and makes recommendations to the department of natural resources with regard to requests for funding.
The Off-Highway Motorcycle Council will meet to review updated information on completed projects previously awarded grants. The public will be invited to join the meeting via Zoom or in-person. The Zoom meeting link, agenda, and other meeting materials are available on the OHM Council webpage.

Prehearing Conference for Contested Case Hearing on Mathy Construction/Milestone Materials’ application for Wis. Stat. Chapter 30 permits to conduct nonmetallic mining

On May 28, 2021, the Wisconsin Department of Natural Resources (DNR) denied Mathy Construction/Milestone Materials’ (“Petitioner”) application for Wis. Stat. Chapter 30 permits to conduct nonmetallic mining by removing materials form the bed and bank of Taylor Creek as well as an additional pond connected to the Chippewa River. Petitioner had been granted permits for this nonmetallic mining in 2010, which was extended and expires April 29, 2022. The DNR determined that the Petitioner’s proposed mining activity is and has been detrimental to the public interest in Taylor Creek and the Chippewa River and denied the application.
On June 24, 2021, the Petitioner filed a Petition for Administrative Review with the DNR to review the decision to deny the application, pursuant to Wis. Stat. § 30.209(1m) and Wis. Admin. Code § NR 310.18(1).
By letter dated July 26, 2021, the DNR granted the request for a contested case hearing and limited the hearing to the following issue: whether the DNR properly determined that Permit Application IP-WC-2020-18-00477 failed to meet the standards of Wis. Stat. §§ 30.19 and 30.20 and Wis. Admin. Code Chs. NR 299 and 340.
On Oct. 1, 2021, the Division of Hearings and Appeals received, for filing, an original request for hearing from the DNR. The parties have conferred and agreed to a date for a prehearing conference and hearing.
NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a prehearing conference on the above-captioned matter pursuant to Wis. Stat. § 227.46(1) and Wis. Admin. Code §§ NR 2.08(5) and 2.12, via the BlueJeans videoconferencing platform Dec. 8, 2021 at 10 a.m.
Interested persons must contact the Division of Hearings and Appeals at (608) 266-7709 for instructions on how to attend the prehearing conference.
Any person, organization, or governmental unit wishing to become a party to this proceeding must attend the conference personally or by an authorized representative. The purpose of the prehearing conference will be to identify parties to the proceeding, to simplify or clarify the issues which may be contested at the hearing, identify witnesses, discuss the exchange of exhibits, establish a discovery schedule, address any other matters as may aid in the disposition of the action, and confirm the date for the contested case hearing. No testimony will be heard at the prehearing conference.

Topics covered will include a brief overview of legal requirements and information how haulers can assist their municipal customers with recycling reporting.

The DNR will host a public comment meeting on the Chronic Wasting Disease (CWD) Response Plan Review on Friday, Dec. 3 from 9 a.m. to 11 a.m. via Zoom. The meeting is an opportunity for the public to provide input to the CWD Response Plan Review Committee to help inform the review.
Those wishing to make a comment during the meeting must register in advance. Each speaker has a maximum time limit of 5 minutes, and the facilitator may set a time limit of 3 minutes. Please be prepared for either time limit.
Those wishing to observe the meeting without commenting may watch the meeting live via YouTube without registering.
Input can also be provided to the Committee at any time via the CWD Response Plan Webmail. Input received to this webmail will be shared with the Committee.
The DNR’s 15-year CWD Response Plan, in effect through 2025, helps guide the department’s approach to addressing CWD in Wisconsin. The plan was developed to fulfill its public trust responsibility to manage wildlife and ensure the health of Wisconsin’s wildlife populations. As part of the plan’s implementation, the department will review progress toward meeting its goals and objectives every five years.
