Public Hearing for the 5-year Highest Attainable Condition Evaluation of Wisconsin’s Phosphorus Multi-discharger Phosphorus Variance

On February 6, 2017, the EPA approved the State’s multiple discharger variance (MDV) for the phosphorus surface water quality standard. The MDV provides WPDES permit holders with additional time to comply with low-level phosphorus effluent limits while contributing to nonpoint source phosphorus reductions. The MDV is designed to achieve better environmental outcomes and avoid the adverse economic impacts associated with costly wastewater facility upgrades. Pursuant to s. 283.16(3m) Wis. Stats., the variance’s compliance with federal highest attainable condition requirements must be reevaluated 5 years after the initial approval. The department will hold a public hearing to receive additional information and public comment. Written comments will be accepted through Jan. 25, 2022.
