Waterway and Wetland Projects on Public Notice

Public notices are required by statute to alert interested members of the public of the DNR's intention to authorize a Wisconsin Waterway or Wetland individual permit. The public notice for an individual permit application is posted here for 60 days and published once in the legal notices section of the local newspaper closest to the proposed project site. The notice identifies the applicant, location, proposed activities and the proposed impacts to navigable waterways or wetlands.

Submit Public Comments

The public notice document for each application summarizes the project and explains how to submit public comments on the proposed project. A member of the public may submit written comments or request that the department hold a public informational hearing. A request for a public informational hearing must be submitted within 20 days of the posting date of the public notice. Public comments must be submitted within 30 days from the posting date of the public notice unless otherwise indicated in the notice. If a public informational hearing is requested, the public comment period is then extended to 10 days after the date of the hearing.

Public participation procedures are detailed in NR 300, Wis. Adm. Code [PDF exit DNR].

Waterway and Wetland Individual Permit Review Process

  1. Applicants use the DNR Water ePermitting System to submit an individual permit application.
  2. The DNR has 30 days to review the application for completeness and notify the applicant. The DNR can request additional information one time within these 30 days, which would pause the 30-day period until all information requested is received.
  3. The DNR has 15 days to publish the public notice on its website and notify interested parties as determined under s. NR 300.07 (5), Wis. Adm. Code.
  4. The DNR provides a public comment period of at least 30 days.
  5. Any member of the public or the DNR may request a public informational hearing within 20 days of the public notice publishing date.
  6. If a public hearing is requested, the DNR has 15 days to provide public notice of the hearing and will hold a hearing within 30 days of the hearing notice.
  7. The public comment period will end either 30 days after the public notice publishing date or 10 days after the public informational hearing.
  8. The DNR typically has 30 days from the end of the public comment period if no public hearing was requested or 20 days from the public hearing date to communicate a decision to the applicant about the permit application.
